CODE OF CONDUCT

Here within is the Code of Conduct for the Rho Chapter of Tau Kappa Epsilon fraternity.

ARTICLE I.

Rho Chapter of Tau Kappa Epsilon Fraternity expects that every member share its commitment to honesty, integrity and the quest to become a gentleman. In addition, the Rho Chapter of Tau Kappa Epsilon Fraternity is expects that its fraters will show brotherhood, educational, personal and social growth throughout their fraternal experience. It is expected that each frater will also grow to have greater respect for self, others, and property.

Fraters are required to engage in responsible social conduct that reflects positively upon Tau Kappa Epsilon Fraternity and to model good citizenship in any community.

The Fraternity will not request special consideration for its members charged with violations of a city, county, or state law on the basis of their status as a frater, nor will prosecution by federal, state, or local authorities preclude disciplinary action by the Fraternity.

All fraters who assume the bond of Rho Chapter must adhere to the Code-of-Conduct, if they are in violation they will be brought in front of the Membership Quality Board and subsequently in front of the Alumni Judicial Board. If a member refuses to show at either Board he is admitting his guilt. Each frater has the right to present his case to both Boards, but the decision of both Boards shall be followed. The decision of the Alumni Judicial Board will be final.

Refer to the Rho Chapter of Tau Kappa Epsilon's Constitution and to Tau Kappa Epsilon's Nationals website to see who constitutes the members of the Membership Quality Board and the Alumni Judicial Board. The duties, responsibilities, and powers of both Boards are listed there.

ARTICLE II.

The Fraternities Code-of-Conduct applies to all members who assume the bond, taking place anywhere, at anytime, in the "Fraternity" House or outside the "Fraternity" House. "Fraternity" House refers to any house that is used and identified by it members as the "Fraternity" House.

The following is the Code-of-Conduct list:

 
1) Physical abuse, verbal abuse, threats, intimidation, coercion and/or other conduct which threatens or endangers the health or safety of any member.
 
2) Attempted or actual theft of and/or damage to Fraternity property or "Fraternity" House.
 
3) Hazing.
 
4) Sexual offenses, including, but not limited to:
 
A) Sexual intercourse with, and/or sexual intrusion against, a person capable of giving consent, without such person's consent, or a person incapable of giving consent;
 
B) Sexual assault or abuse, statutory or acquaintance rape, sexual harassment.
 
5) Failure to comply with law enforcement officers or interfering with the performance of their duties and/or failure to identify oneself to these persons when requested to do so.
 
6) Unauthorized possession, duplication or use of keys to any members rooms, houses, or TKE property; or unauthorized entry to or use of those premises.
 
7) Violation of any federal, state, or local laws.
 
8) Illegal or unauthorized possession of firearms, explosives, other weapons, or dangerous chemicals on Fraternity property or in the "Fraternity" House. This also covers the use of any such item, even if legally possessed, in a manner that harms, threatens, or causes fear to others.
 
9) Use, possession, or distribution of narcotic or other controlled substances except as expressly permitted by law.
 
10) Conduct which is disorderly, lewd, or indecent; breach of peace; or aiding, abetting, or procuring another person to breach the peace on Fraternity or University property or at functions sponsored by, or participated in by, the Fraternity.

The Fraternity will cooperate fully with law enforcement and other agencies in the enforcement of criminal law with in the community and with the conditions imposed by the criminal courts for the rehabilitation of violators.

As stated in the Black Book any member may bring charges against another member. These charges must be brought to the Membership Quality Board.

ARTICLE III.

SANCTIONS: The following sanctions may be imposed upon any member found to have violated the Code-of-Conduct.

 
1) Warning - A notice written or verbally to the member that is violating or has violated the Fraternities Code-of-Conduct.
 
2) Probation - A written reprimand for violation of specified regulations. Probation is for a designated period of time and includes the probability of more severe disciplinary sanctions if the member is found violating any regulation(s) during their probationary period.
 
3) Loss of Privileges - Denial of specified privileges for a designated period of time.
 
4) Fines - Are amounts imposed to encourage a member to change his behavior; or amounts imposed to cover the cost of repair or replacement of damaged property.
 
5) Restitution - Compensation for loss, damage, or injury. This may take form of appropriate service and/or monetary or material replacement.
 
6) House Expulsion - Permanent separation of the member from the "Fraternity" House. This doesn't exclude the member from his rent or other financial obligations.
 
7) Fraternity Suspension - Separation of the member from membership in the Fraternity for a designated period of time.
 
8) Fraternity Expulsion - The descrolling of a member.

ARTICLE IV.

Any questions of interpretation regarding the Code-of-Conduct shall be referred to the Alumni Judicial Board.



I have read and understand the preceding Code-of-Conduct and will abide by all of the articles. I agree to any and all judgments and rulings rendered by the Chapter or Judicial Board/Committee if I violate any section of this Code-of-Conduct.
